What a second review is
The associate or partner already drafted the petition. That is the first pass. A second review is the structured look at that draft before you file.
USCIS may deny a petition for missing required initial evidence without first issuing an RFE or a NOID. A policy update dated 5 August 2026 is the current statement of that point. The second pass exists so counsel can see completeness problems while the packet is still in the office. It is a pre-filing completeness review. It is not a claim about RFEs, and it does not predict what the officer will do.
You already have the case on paper. The kit inventories the record, checks claims against the classification sources for the petition you are actually filing (EB-1A, EB-2 NIW, or O-1A), lists gaps and weak points, and writes a memo for counsel.

How the workflow runs
- Classification lockConfirm the draft is EB-1A, EB-2 NIW, or O-1A. Flag mixed standards. Do not “fix” them by importing another kit.

Why the second pass exists
The first pass is drafting. That is the argument, the exhibit list, the letters. The second pass is a structured look at whether the draft is complete against the live standard, and whether the claims are actually in the record.
After the 5 August 2026 policy update, missing required initial evidence can end in a denial without an RFE. Counsel already knew completeness mattered. The policy makes the cost of a thin packet more immediate. The job of the second review is to put those holes on a page before the packet leaves. It does not make the filing safe. It does not promise an RFE instead of a denial.
A model will often agree with the draft you feed it. Agreeing with the brief is not a second review. A second review inventories the file, maps claims to exhibits, lists gaps, and hands counsel a memo. Counsel decides what to do.
